Gardner Indicted on All Three Charges, Will Find out Trial Date Today

Arlington County Circuit Court Grand Jury indicted Gardner Monday.

An Arlington County Circuit Court Grand Jury indicted Michael A. Gardner Monday on charges of two counts of aggravated sexual battery and a single count of object sexual penetration. A court official confirmed Gardner was indicted and said a trial date will be set today during court.

On July 12, the two young girls, ages 9 and 10, gave graphic of the alleged sexual incidents involving Gardner that happened during a birthday sleepover on June 18 inside Gardner's home. A third girl, 10-years-old, also testified July 12 about a separate incident that allegedly happened June 16.

Gardner’s attorney Peter Greenspun and Loudoun County Deputy Commonwealth Attorney Nicole Wittman, who is prosecuting the case did not return voice messages left Thursday.

Gardner, who served as chairman of the Falls Church City Democratic Committee from 2006 to 2007, is out on a $50,000 bond. Judge Esther Wiggins said Gardner still cannot see his children that he hasn’t seen since he was charged in June. Wiggins said she has concerns about Gardner being around his 10-year-old fraternal twins — a boy and a girl.
