New Delegate Marcus Simon Readies Anti-Porn, Anti-Gun Bills for General Assembly

Falls Church lawmaker to introduce bill that aims to outlaw "revenge porn." Another proposal would ban guns for stalkers and domestic abusers.

Newly elected Del. Marcus Simon, who represents Falls Church, isn't wasting any time. He's already proposing legislation for the 2014 General Assembly, which will convene Jan. 8 in Richmond.

Simon is introducing a bill that would ban sharing nude or sexually explicit photos to harass or hurt someone.

The proposed law is HB49: Unlawful dissemination or sale of images of another. Provides that a person is guilty of a Class 1 misdemeanor if he, with the intent to cause substantial emotional distress, disseminates or sells any videotape, photograph, film, or other videographic or still image or reproduction thereof that depicts another person who is totally nude, in a state of undress, or engaged in sexual conduct where such person knows or has reason to know that he is not licensed or privileged to do so and the person depicted suffers substantial emotional distress. View Full Text »

The proposed law is HB48: Possession of firearms following conviction of certain crimes; penalty. Prohibits any person who is convicted of stalking, sexual battery, or assault and battery of a family member that results in serious bodily injury from possessing, transporting, or carrying a firearm or any other weapon for a period of five years following his conviction. A violation would constitute a Class 6 felony. The bill also provides for the forfeiture of any weapon possessed, transported, or carried in violation of the prohibition. Finally, the bill provides for a process by which a violator may petition the circuit court for a reinstatement of his rights to possess, transport, or carry a weapon. Amends § 19.2-386.28, of the Code of Virginia.View Full Text »
