Yelp! Comment Case: Order for Woman to Delete Parts of Comments Reversed

Virginia Supreme Court reversed the order against Jane Perez of Falls Church on Friday; ACLU notes 'importance of free speech.'

The Virginia Supreme Court reversed a preliminary injunction that stopped a Falls Church woman from accusing a contractor of stealing jewelry from her home on a popular consumer website. Friday, the Commonwealth’s high court reversed the injunction ordered by Fairfax County Circuit Court Judge Thomas Fortkort in December that forced Jane Perez to take down some of her comments on Yelp.com about Christopher Dietz. Perez reportedly wrote angry reviews on Yelp and Angie’s List alleging Dietz, a contractor, stole jewelry from her home and caused about $15,000 in damages to her home. “As we begin the New Year, the Supreme Court’s ruling is a great reminder of the importance of free speech in our society,” ACLU of Virginia Legal Director Rebecca…

Anglican Parish Appeals Fairfax Court Decision

The Falls Church Anglican doesn’t believe ruling that forfeited approximately $2.8M was constitutional.

The Anglican parish that was forced out of The Falls Church filed a petition for appeal with the Virginia Supreme Court Friday. The parish left the church May 15 after Fairfax County Circuit Court Judge Randy Bellows told The Falls Church and six other congregations in the Northern Virginia area in December to give their church property to the diocese they divorced years ago. The 113-page ruling came after almost five years of litigation and hundreds of thousands of dollars in congregation-donated defense funds. The petition requests the court review a number of legal and constitutional grounds, according to a statement released Friday. A senior member of the congregation could not be reached for comment. Dela Rosa Scheduled for Sentencing Friday

Grandmother was found guilty of first degree murder in October

A Fairfax woman who was found guilty last fall of murdering her granddaughter will be sentenced at 10 a.m. Friday in Fairfax County Circuit Court Carmela dela Rosa threw 2-year-old Angelyn Ogdoc off a pedestrian footbridge that connected a multi-level parking garage to the food court at Tysons Corner Center mall on Nov. 29, 2010. The drop was approximately 44 feet. The child, her granddaughter, died from her injuries the following morning. Dela Rosa pleaded not guilty to the murder charge. Her defense team tried to prove she was insane at the time of the crime, but the jury convicted dela Rosa of first degree murder on Oct. 6. I hope she gets the maximum. Imagine the terror and pain that poor baby felt when someone she loved and trusted threw her to her death! Even if the woman resented the baby's father for getting her daughter pregnant, as was stated in her testimony, it's no reason to take it out on the child!   more ›
